To qualify as an outstanding professor or researcher (EB-1B), an applicant must be engaged in academic research or teaching, and must have a qualifying offer of employment. The offer may be from a university or institution of higher learning for a tenure-track teaching position or a permanent research position. The offer of employment can also be from a private employer which is offering the applicant a permanent research position. The offered position is permanent if it has a term of indefinite or unlimited duration in which the researcher will have an expectation of continued employment unless there is good cause for termination. A private employer must establish that it employs at least three persons in research positions and that it has documented achievements in the academic field, which can be shown through such evidence as patents, research grants awarded by prestigious organizations, or other prizes and honors granted to the employer.
 
The applicant must demonstrate that s/he has at least three years of experience in teaching or research. Research experience gained while working toward an advanced degree can be counted so long as the applicant completed the degree and the research conducted has been recognized as outstanding. Pre-degree teaching experience is acceptable if the applicant has acquired the degree, and had full responsibility for the courses taught. A combination of teaching or research totaling three years will meet the experience requirement.
 
Outstanding teachers or researchers must be recognized internationally. This may be shown by presenting evidence that the individual meets at least two of the following six criteria (the more, the better).
 
  • Receipt of major prizes or awards for outstanding achievement in the academic field.
  • Membership in associations in the field which require outstanding achievements of their members.
  • Published material in professional publications written by others about the applicant's work in the academic field.
  • Participation as the judge of the work of others in the same or an allied academic field.
  • Original scientific or scholarly research contribution.
  • Authorship of scholarly books or articles in scholarly journals with international circulation in the academic field.
