To qualify as an outstanding professor or researcher (EB-1B), an applicant must be engaged in academic research or teaching, and must have a qualifying offer of employment. The offer may be from a university or institution of higher learning for a tenure-track teaching position or a permanent research position. The offer of employment can also be from a private employer which is offering the applicant a permanent research position. The offered position is permanent if it has a term of indefinite or unlimited duration in which the researcher will have an expectation of continued employment unless there is good cause for termination. A private employer must establish that it employs at least three persons in research positions and that it has documented achievements in the academic field, which can be shown through such evidence as patents, research grants awarded by prestigious organizations, or other prizes and honors granted to the employer.
